States must make annual determinations of each local educational agency (LEA) within the state to assess the implementation of IDEA based on performance on the State Performance Plan indicators; validity and reliability of data timely submitted by LEA;  evidence of uncorrected noncompliance; and any audit findings.

On June 3, 2009, the state of New York received a “Needs Assistance” rating from the U.S. Department of Education for a third consecutive year on its implementation of the IDEA. However, most LEAs in the state have been rated as “Meets Requirements” by the state. Information on the NY rating from USED is available here.
